This Combined Terms of Service Agreement (“TOS” or “Agreement”) is a legally binding agreement between you and Notary Trails (“Company,” “we,” “us,” or “our”), located at 6520 Lonetree Blvd #2010, Rocklin, CA 95765. It governs your use of our website (www.notarytrails.com), all associated online services and mobile applications, and our SMS/text messaging program. This Agreement incorporates by reference our Combined Privacy Policy, available at notarytrails.com/privacy-policy.
PART ONE: WEBSITE & ONLINE SERVICES TERMS
1. Description of Services
Notary Trails is a Nationwide Mobile Notary Signing Service that connects clients with commissioned mobile notaries and Remote Online Notaries (RON) across all 50 states and internationally. Our services include mobile notary appointments, remote online notarizations, apostille processing, and related signing coordination services.
All visitors to our site are deemed “users” for purposes of this TOS. Notary Trails reserves the right to modify, update, or discontinue any services at its discretion. Your continued use of our services following any such changes constitutes acceptance of those changes.
All services are provided “AS IS.” Notary Trails does not assume responsibility for timeliness, missed delivery, or failure to store user content or personalization settings.
2. Privacy Policy
Your personal information is governed by the Notary Trails Combined Privacy Policy, available at notarytrails.com/privacy-policy, incorporated herein by reference. By using our services, you consent to the collection and use of information as described in that policy, including transfer of information within the United States and other countries for storage, processing, or use by Notary Trails and its subsidiaries and affiliates.
3. Export and Import Compliance
By using our network, you agree to comply with all applicable export and import laws, statutes, and regulations, including the Export Administration Regulations and U.S. sanctions programs. You represent that you are not on any government export exclusion list or a member of an export-prohibited country, and you agree not to use our services for any prohibited end use.
4. User-Submitted Content
Notary Trails does not claim ownership of content submitted by users. However, by submitting content to publicly accessible areas of our site, you grant Notary Trails a worldwide, royalty-free, non-exclusive license to use, distribute, reproduce, modify, adapt, publicly perform, and publicly display such content solely for the purpose of providing and promoting the applicable service area. This license terminates when you discontinue your membership.
5. Contributions to Our Website
When you submit ideas, documents, suggestions, or proposals to our site, you acknowledge and agree that:
• a) Your contributions do not contain confidential or proprietary information;
• b) Notary Trails is not obligated to maintain confidentiality of any contributions;
• c) Notary Trails may use or disclose contributions in any manner it sees fit;
• d) Contributions automatically become the sole property of Notary Trails; and
• e) Notary Trails is under no obligation to compensate you for contributions.
6. Indemnification
You agree to indemnify and hold harmless Notary Trails, its subsidiaries, affiliates, agents, employees, officers, partners, and licensors from any claim, demand, or damage — including reasonable attorney fees — made by any third party arising from content you submit or transmit through our services, your use of our services, your violation of this TOS, or your violation of any rights of another person or entity.
7. Prohibited Commercial Reuse
You agree not to replicate, duplicate, copy, trade, sell, resell, or otherwise exploit for any commercial purpose any part of, access to, or use of Notary Trails’s sites or services.
8. Modifications to Services
Notary Trails reserves the right to modify, alter, or discontinue any part of its services, temporarily or permanently, with or without prior notice. We shall not be liable to you or any third party for any such modification, suspension, or discontinuance.
9. Advertisers and Third-Party Links
Any dealings with advertisers or third-party services found on or through our platform are solely between you and that third party. Notary Trails is not responsible for any loss or damage arising from such dealings or from third-party content, products, or services linked from our site.
10. Proprietary Rights
All Notary Trails trademarks, service marks, trade names, logos, and brand features are the sole property of Notary Trails. You may not display or use any Notary Trails marks without prior written consent. All software used in connection with our services is proprietary and protected by applicable intellectual property laws.
You are granted a personal, non-transferable, non-exclusive license to use our software on a single device. You agree not to reverse engineer, decompile, sell, sublicense, or attempt to derive source code from our software.
11. Warranty Disclaimers
YOU ACKNOWLEDGE AND AGREE THAT:
• a) USE OF NOTARY TRAILS SERVICES AND SOFTWARE IS AT YOUR SOLE RISK. ALL SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
• b) NOTARY TRAILS DOES NOT WARRANT THAT SERVICES WILL MEET YOUR REQUIREMENTS, BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, OR THAT RESULTS OBTAINED WILL BE ACCURATE OR RELIABLE.
• c) ANY MATERIAL DOWNLOADED OR OBTAINED THROUGH OUR SERVICES IS ACCESSED AT YOUR OWN RISK. YOU ARE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR DEVICE OR LOSS OF DATA.
• d) NO ORAL OR WRITTEN ADVICE FROM NOTARY TRAILS CREATES ANY WARRANTY NOT EXPRESSLY STATED IN THIS TOS.
Photosensitivity Notice: A small percentage of users may experience epileptic symptoms when exposed to certain light patterns on a computer screen. If you or a family member has an epileptic condition, please consult a physician before use and contact us if you experience dizziness, altered vision, eye or muscle twitches, disorientation, or involuntary movement while using our services.
12. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, NOTARY TRAILS AND ITS SUBSIDIARIES, AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, PARTNERS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY PUNITIVE, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING LOSS OF PROFITS, GOODWILL, USE, OR DATA, ARISING FROM:
• a) The use or inability to use our services;
• b) The cost of procuring substitute goods or services;
• c) Unauthorized access to or alteration of your transmissions or data;
• d) Statements or conduct of any third party on our service; or
• e) Any other matter related to our services.
SOME JURISDICTIONS DO NOT ALLOW EXCLUSION OF CERTAIN WARRANTIES OR LIMITATIONS OF LIABILITY. IN SUCH JURISDICTIONS, OUR LIABILITY IS LIMITED TO THE FULLEST EXTENT PERMITTED BY LAW.
13. Release of Claims
In the event of a dispute, you agree to release Notary Trails and its officers, directors, employees, agents, subsidiaries, affiliates, co-branders, partners, and third parties from all claims, demands, and damages (actual and consequential) of every kind, known and unknown, arising out of or connected to such dispute.
14. Financial Matters Disclaimer
Content provided through our services is for informational purposes only and is not intended for trading or investment purposes. Notary Trails and its licensors are not responsible for the accuracy, usefulness, or availability of any financial information transmitted through our services.
15. Copyright and Intellectual Property Infringement
Notary Trails respects intellectual property rights and expects users to do the same. We may disable or terminate accounts of users who infringe intellectual property rights. To report a copyright or IP infringement claim, provide us with:
• a) The electronic or physical signature of the authorized copyright owner or representative;
• b) A description of the copyrighted work believed to be infringed;
• c) The location on our site where the allegedly infringing content appears;
• d) Your contact information (address, phone, email);
• e) A statement that the use is not authorized by the copyright owner, its agents, or the law; and
• f) A statement under penalty of perjury that the information is accurate and you are authorized to act on behalf of the copyright owner.

PART TWO: SMS & TEXT MESSAGING TERMS
By joining the Notary Trails SMS program, you agree to receive recurring text messages — including appointment reminders, job assignments, signing updates, and service notifications — to the mobile number you provide. These terms comply with the Telephone Consumer Protection Act (TCPA), FCC regulations (including April 2025 opt-out rules), and CTIA Best Practices.
17. SMS Opt-In Consent
Your participation in our SMS program requires explicit, one-to-one written consent as required under the TCPA. By opting in, you consent to receive messages from Notary Trails only. Your consent cannot be shared with or transferred to any other company or third-party entity without your direct and separate approval.
You may opt into our SMS program through the following methods:
• Web Form: Check a clearly labeled opt-in checkbox on our website at notarytrails.com/notaries or during the client registration or booking process.
Opting into our SMS program is voluntary and is never a condition of purchasing our services.
18. Message Types and Frequency
Messages you may receive include appointment confirmations and reminders, notary job assignments and updates, document return and completion notifications, service-related announcements, and operational alerts. Message frequency will vary based on your service activity but will generally not exceed 3–5 messages per day unless a time-sensitive event requires additional contact.
19. Message and Data Rates
Standard carrier message and data rates may apply depending on your mobile carrier and plan. Notary Trails is not liable for any carrier charges you incur. Please review your carrier’s terms for details on applicable fees.
20. Opt-Out and HELP Instructions
You may opt out of our SMS program at any time using any of the following methods:
• Reply STOP: Text “STOP” to any message to unsubscribe immediately. You will receive a single confirmation message with no promotional content within 5 minutes, and no further messages will be sent unless you opt back in.
• Reply HELP: Text “HELP” to receive contact and support information.
• Email: Contact [email protected] and request removal from SMS communications.
• Phone: Call 916-800-7773 to request opt-out.
• Website: Submit a request at notarytrails.com/contact.
In compliance with FCC April 2025 rules, Notary Trails honors opt-out requests through any reasonable channel within 10 business days.
21. SMS Privacy and Data Use
Your mobile number and SMS interaction data are governed by the Notary Trails Combined Privacy Policy at notarytrails.com/privacy-policy. Your data is used solely for the purpose of delivering SMS messages and demonstrating regulatory compliance. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes at any time.
22. SMS Record-Keeping and Compliance
Notary Trails maintains detailed records of all SMS opt-ins and opt-outs, including dates, times, and consent methods, to satisfy TCPA and Campaign Registry proof-of-consent requirements. We comply with A2P 10DLC registration requirements for business text messaging. These records are maintained securely and may be used to demonstrate compliance in the event of a regulatory inquiry or legal proceeding.
23. SMS Service Availability and Disclaimers
SMS message delivery is dependent on carrier networks and third-party messaging platforms. Notary Trails cannot guarantee uninterrupted service, specific delivery times, or that all messages will be received. We are not liable for any delays, failed deliveries, or errors attributable to carrier networks or factors outside our control.
24. Changes to SMS Terms
Notary Trails reserves the right to update these SMS Terms at any time. Material changes will be communicated via SMS notification or posted on our website. Continued participation in the SMS program after such changes constitutes your acceptance of the revised terms.
PART THREE: GENERAL PROVISIONS
25. Entire Agreement
This TOS, together with the Notary Trails Combined Privacy Policy and any additional terms applicable to specific services, constitutes the entire agreement between you and Notary Trails and supersedes all prior agreements with respect to our services. You may also be subject to supplemental terms when using certain Notary Trails services, affiliate services, or third-party software.
26. Governing Law and Dispute Forum
This Agreement shall be governed by the laws of the State of California, without regard to conflict of law provisions. Any claims, causes of action, or disputes arising out of or relating to this TOS shall be filed in the courts having jurisdiction within Placer County, California, or the applicable U.S. District Court. Both parties consent to the jurisdiction of such courts and waive any objection to venue.
27. Waiver and Severability
Failure by Notary Trails to exercise or enforce any right or provision of this TOS shall not constitute a waiver of that right or provision. If any provision of this TOS is found by a court of competent jurisdiction to be invalid, the remaining provisions shall remain in full force and effect, and the court shall give effect to the parties’ intentions as reflected in the original provision.
28. Statute of Limitations
You agree that, regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to your use of our services or this TOS must be filed within one (1) year after such claim or cause of action arose, or it will be forever barred.
29. Notices
Notary Trails may provide notices to you via email, postal mail, SMS, website postings, or other reasonable means. Notices sent to you are effective upon sending if delivered to the contact information you have provided. Your acceptance of this TOS constitutes agreement that you are deemed to have received any notices that would have been delivered had you accessed our services in an authorized manner.
30. Third-Party Beneficiaries
Unless otherwise expressly stated in this TOS, there are no third-party beneficiaries to this Agreement.
